We reserve the right to modify or discontinue services at any time.

3. Eligibility

By using our services, you confirm that:

• You have the authority to act on behalf of your company (if applicable)
• Your use complies with all applicable laws and regulations

4. Account & Access

You are responsible for:

You remain fully responsible for your email practices and compliance.

6. Client Responsibilities (Critical)

As a consulting service, MailAdept provides guidance and technical implementation, but:

• You are solely responsible for your email campaigns
• You control your sending behavior, content, and recipients
• You must ensure legal compliance (GDPR, CAN-SPAM, etc.)

We do not guarantee:

• Inbox placement
• Open rates or performance
• Absence of spam filtering

Email deliverability depends on multiple external factors outside our control.

7. Technical Access & Credentials

To provide services, you may grant access to:

• Email accounts (SMTP, ESPs)
• DNS/domain configuration
• Third-party tools or platforms

You acknowledge that:

• Access is granted voluntarily
• You may revoke access at any time
• We will use access strictly for service delivery

We implement strong security measures, but:

You remain responsible for:

• Your infrastructure security
• Credential management
• Third-party integrations

8. Fees & Payments

For paid services:

• Fees are defined in proposals, contracts, or subscription plans
• Payments are processed via third-party providers (e.g. Stripe)
• All fees are non-refundable unless otherwise agreed

Failure to pay may result in:

9. Intellectual Property

11. Disclaimer of Warranties

MailAdept services are provided "as is" and "as available."

We make no guarantees regarding:

• Deliverability performance
• Business outcomes
• Continuous or error-free service

Email ecosystems (Gmail, Outlook, etc.) are external systems we do not control.

12. Limitation of Liability

To the maximum extent permitted by law:

MailAdept shall not be liable for:

• Indirect or consequential damages
• Loss of revenue, data, or business
• Email blocking, spam filtering, or reputation issues

Our total liability is limited to the amount paid for services in the last 3 months.

13. Indemnification

You agree to indemnify and hold harmless MailAdept from any claims arising from:

• Your email campaigns or practices
• Violation of laws or regulations
• Misuse of our services

14. Termination

We may suspend or terminate access:

• If you violate these Terms
• If misuse or abuse is detected
• For legal or security reasons

You may stop using our services at any time.

15. Data Protection

Your use of our services is also governed by our Privacy Policy.

16. Data Processing Agreement (DPA)

For clients, a Data Processing Agreement (DPA) is available upon request.
